1. INTRODUCTION

1.1 This Acceptable Use Policy ("Policy") governs your use of the socialrealestate.com.au website, which include displaying residential and commercial property listings for sale or rent, agent profile information, and using the socialrealestate.com.au Admin System to manage listings. This website, along with associated services, are collectively referred to as "the Service."

1.2 This Policy forms an integral part of your agreement with us for access and use of the Service.

1.3 We reserve the right to modify this Policy in accordance with the Terms and Conditions applicable to the Service.

1.4 To maintain the quality of listing and profile content on socialrealestate.com.au, we may issue directions for content modification where reasonably necessary.

1.5 We may interpret and apply the rules set out in this Policy in good faith and as needed to maintain the quality, integrity, and trust of the socialrealestate.com.au website.

2. YOUR OBLIGATIONS

2.1 You must comply with the provisions of this Policy at all times.

2.2 The Service may only be used for its intended purposes, as specified in this Policy and the Terms and Conditions. Any use beyond these purposes is strictly prohibited.

2.3 Use of the Service must be responsible and should not adversely impact other users of socialrealestate.com.au.

3. ACCEPTABLE USE

3.1 The Service may be used to list properties and businesses for sale or lease, subject to compliance with the Terms and Conditions and this Policy.

3.2 Agents with a socialrealestate.com.au subscription may list properties within the "Buy" and "Rent" sections of the socialrealestate.com.au website. Developers with a socialrealestate.com.au subscription can list properties in "New Homes" sections which include House and Land Packages, New Apartments, and Land Estates and may advertise individual House & Land Packages, New Apartments, or Land Estates in the "Buy" section of the socialrealestate.com.au website.

3.3 You may only list properties for which you have a valid Agency Agreement or Authority to Sell, in compliance with your state or territory's legal requirements.

4. UNACCEPTABLE USE

4.1 The following activities constitute unacceptable use of the Service:

4.1.1 Inappropriate Listings

  • Listing non-real estate items such as vehicles, boats, or caravans.
  • Using listings to promote businesses or agents instead of properties for sale or lease.

4.1.2 Misclassification of Listings

  • Listing properties in incorrect sections, such as properties for rent under ‘Buy’, Commercial property listing under Residential categories for ‘Buy or Lease.’
  • Listing individual rooms or short-term rentals under the residential rental section unless otherwise approved by Social Real Estate.

4.1.3 Improper Content

  • Including irrelevant information or promotional content such as an Agents email address, mobile or office number or any other contact information within listing fields and images that are not supported by socialrealestate.com.au.
  • Using incorrect or misleading images, including lifestyle photos as the main image and signboards with or without contact information.
  • Placing watermarks, text, or marketing elements on images outside permitted standards.

4.1.4 Duplicate and Misleading Listings

  • Posting duplicate property listings or creating false street or suburb names.
  • Creating misleading or deceptive listings, such as marking unsold properties as ‘Sold’ or ‘Sold properties’ labelled as ‘Under contract’ or any other term.

4.1.5 Unauthorised and Inappropriate Listings

  • Listing properties without proper authority or where you are not the primary listing agent.
  • Advertising properties on behalf of non-subscribed real estate offices.
  • Listing properties in states or territories where you are not licensed.

4.1.6 Misuse of Videos or Other Media

  • Videos and images must relate directly to the property being marketed and include only socialrealestate.com.au contact links.
  • Agency branding in media must not obstruct content, and promotional content is limited to a transparent non-colour watermark of 170 x 34 pixels, and situated in the bottom right-hand corner of the listing.
  • Videos must not contain external links or contact information.

4.1.7 Other Violations

  • Misusing a product or feature to gain an unfair advantage or harm others.
  • Listing more than one property per listing.
  • Failing to verify the authenticity of listings and prevent fraudulent activities.

5. BREACH OF POLICY

5.1 Use of the Service in violation of this Policy constitutes a breach of your agreement with socialrealestate.com.au.

5.2 If a breach occurs, we may take corrective action, including suspending or terminating your subscription, deleting specific listings, or preventing future listings.

5.3 If you are notified of a breach, you must remedy it within the specified timeframe. Failure to comply may result in additional actions, including immediate termination.

5.4 We may suspend or terminate your access to the Service where:

  • A material breach of this Policy has occurred.
  • A breach is not remedied within the specified period.

5.5 You will remain responsible for your contractual obligations, including payment, during any suspension or until the agreement is terminated.

6. COMPLIANCE WITH AUSTRALIAN LAWS AND REGULATIONS

6.1 All listings and content must comply with relevant Australian laws and regulations, including but not limited to:

  • The Australian Consumer Law
  • State and territory property and real estate legislation
  • Privacy Act 1988 (Cth)
  • Anti-discrimination legislation
  • Australian Competition and Consumer Commission guidelines for digital platforms

6.2 Real estate agents must ensure they hold valid licences for the state or territory in which they list properties, as required by state and territory real estate licensing authorities.

6.3 All property information must be accurate and not misleading according to ACCC guidelines, including price representations and property features where required.

7. PRIVACY AND DATA PROTECTION

7.1 You must comply with the Australian Privacy Principles when collecting, using, and managing personal information obtained through the Service.

7.2 Property images must respect privacy considerations, including avoiding unintentional capture of identifiable individuals, neighbouring properties, or sensitive information.

7.3 You must obtain appropriate permissions before using images of individuals in your property listings.

8. FINAL PROVISIONS

8.1 socialrealestate.com.au retains the right to update, modify, or replace this Policy from time to time. Continued use of the Service constitutes acceptance of the most recent version.

8.2 If any provision of this Policy is found to be invalid or unenforceable, the remaining provisions shall continue to apply in full force and effect.
